Terms & Conditions

The fol­low­ing are the stan­dard Terms & Con­di­tions that apply to all busi­ness con­duct­ed with All Ways Spain (also here­after referred to as “we”, “us” or “our”):

1.Bookings

Once we have dis­cussed with you and you have select­ed the arrange­ments you would like, please e-mail to us all essen­tial details there­of such as dates, the num­ber and full names of peo­ple in your group/party, any spe­cial require­ments and all rel­e­vant con­tact details. No pay­ment will be processed until after we have con­firmed avail­abil­i­ty of the holiday/activity.

Pro­vid­ed the holiday/activity you want is avail­able, we will process pay­ment of the cor­rect deposit or full pay­ment (as per para­graph 2. below), and send you by e-mail a Book­ing Con­fir­ma­tion detail­ing your arrange­ments, names and address­es of per­sons booked, accom­mo­da­tion, and a copy of your full Itin­er­ary. If we are unable to accept your book­ing we shall inform you of this by e-mail and shall not process your pay­ment.

A bind­ing con­tract will come into force between us at the time we send out our Book­ing Con­fir­ma­tion, and until then we shall be under no lia­bil­i­ty to you what­so­ev­er. Such con­tract shall be deemed to incor­po­rate these Terms & Con­di­tions.

The Book­ing Con­fir­ma­tion will be sent to the e-mail address which you give us at the time of book­ing. You must ensure that this is a cor­rect and valid e-mail address. If you do not have an e-mail address, please advise us of a suit­able alter­na­tive form of con­tact which we can use instead.

If at any time there are changes in the details sup­plied to us by you it is your respon­si­bil­i­ty to inform us as soon as pos­si­ble. In par­tic­u­lar, it is essen­tial that you advise of us of any alter­ations or sub­stan­tial delays in your trav­el plans, as we shall bear no respon­si­bil­i­ty for any loss caused as a result of your fail­ure to do so.

No per­son under the age of eigh­teen (18) will be per­mit­ted to book with us with­out the signed con­sent of a par­ent or legal guardian.

Reser­va­tions made by agents and pri­vate groups are sub­ject to these Terms & Con­di­tions. If pay­ment is made to an agent this is held on behalf of, and forms the basis of your con­tract with, All Ways Spain.

Please check your Book­ing Con­fir­ma­tion care­ful­ly upon receipt. Con­tact us imme­di­ate­ly if any infor­ma­tion is incor­rect. It may not be pos­si­ble to make changes lat­er.

2.Payment

For book­ings made more than six (6) weeks in advance of the com­mence­ment date of the holiday/activity we will nor­mal­ly request a deposit of 30% of the total price to secure your book­ing, unless oth­er­wise agreed between us. The bal­ance of the price of your hol­i­day must be paid at least six (6) weeks before the hol­i­day com­mence­ment date. If the bal­ance is not paid in time we reserve the right to can­cel your holiday/activity, retain the deposit, and apply the can­cel­la­tion charges set out in para­graph 5. below. If the com­mence­ment date of the holiday/activity is with­in six (6) weeks at the time of the book­ing then the total cost shall be payable in one instal­ment at the time of book­ing, except where oth­er­wise agreed between us.

You may pay using either of the fol­low­ing pay­ment meth­ods:

  1. By e-mail­ing or tele­phon­ing us details of your cred­it or deb­it card (Visa and Mas­ter­card only – please note we can­not accept oth­er brands such as Amer­i­can Express); or
  2. By bank/wire trans­fer in Euros to our Span­ish bank account, for which you will need cer­tain account details which will be sent to you by e-mail, and all charges (sender and receiv­er) in rela­tion to which you shall be sole­ly respon­si­ble.

The Book­ing Con­fir­ma­tion will include an acknowl­edg­ment of the pay­ment made and will be sent upon com­ple­tion of the transaction/our receipt of cleared funds. Please note that the cleared funds must rep­re­sent the total sum payable to us for the hol­i­day, and as such any bank charges are your sole lia­bil­i­ty.

If we do not receive all pay­ments in full and on time, we reserve the right to treat your book­ing as can­celled in which case can­cel­la­tion charges will be payable (see para­graph 5 below).

3. Prices Include

All prices quot­ed are in Euros (€) and are per per­son, and include the items spec­i­fied in our writ­ten cor­re­spon­dence. Where accom­mo­da­tion is includ­ed, unless oth­er­wise stat­ed, the accom­mo­da­tion price is based on two per­sons shar­ing a twin or dou­ble room.

Sin­gle Sup­ple­ments: As our prices are based upon two peo­ple shar­ing a twin or dou­ble room, if you or any­one in your group requires a room for sin­gle occu­pa­tion, please let us know. A sup­ple­ment will be levied to cov­er the extra costs incurred, at the rates advised by us in cor­re­spon­dence with you.

We guar­an­tee that the price of your arrange­ments will not be sub­ject to any sur­charges once a book­ing has been con­firmed. We reserve the right to increase or decrease our prices at any time until the cost of your cho­sen hol­i­day has been con­firmed.

4. Prices do not include

Inclu­sions are a sub­ject for indi­vid­ual agree­ment and may vary case by case, but in no cir­cum­stances are the fol­low­ing includ­ed in the arrange­ments we sell you:

  • Flights or oth­er inter­na­tion­al trav­el to and from Spain
  • Trav­el insur­ance — this is your respon­si­bil­i­ty to obtain (please see para­graph 6. below)
  • Pass­port or visa fees (if any)
  • Any meals or drinks oth­er than those spec­i­fied in the Itin­er­ary as includ­ed
  • All per­son­al expen­di­tures, includ­ing entrances, enter­tain­ment and trans­porta­tion not includ­ed in the Itin­er­ary, tips and gra­tu­ities
  • Any activ­i­ties or excur­sions that are stat­ed as in any way option­al or addi­tion­al and which we may offer, for which a sep­a­rate price shall be payable

5. Amendments, cancellations and refunds

If you want to change any­thing to do with your book­ing after it has been made we will do our best to help. How­ev­er, we may not always be able to meet your request and have no oblig­a­tion to do so. If you decide to change your hol­i­day in any way once it has com­menced, we accept no lia­bil­i­ty for any loss, dam­age or addi­tion­al expense that you may there­by incur and we can­not guar­an­tee a refund of any costs already paid by you, such refunds being at our sole dis­cre­tion and as may be rea­son­able in the cir­cum­stances. With­out lim­i­ta­tion to the remain­der of these Terms & Con­di­tions, we can­not refund any fees for activ­i­ties or arrange­ments which form part of your Book­ing Con­fir­ma­tion if the noti­fi­ca­tion of can­cel­la­tion or amend­ment is giv­en with less than 48 hours pri­or notice.

We will always endeav­our to pro­vide you with the arrange­ments as set out on the itin­er­ary sent to you with your Book­ing Con­fir­ma­tion. How­ev­er, it may be pos­si­ble that some of the activ­i­ties or accom­mo­da­tion may have to be changed by us for rea­sons beyond our con­trol. We there­fore reserve the right to sub­sti­tute any activ­i­ty, ser­vice or accom­mo­da­tion with anoth­er of equiv­a­lent or high­er val­ue. In the event that we can only locate sub­sti­tute ser­vices or accom­mo­da­tions of a sig­nif­i­cant­ly low­er lev­el of qual­i­ty, as deter­mined by us in our rea­son­able dis­cre­tion, we will refund you an amount equal to the dif­fer­ence in rates between the orig­i­nal and the replace­ment.

Any can­cel­la­tion by you of a con­firmed book­ing, for what­ev­er rea­son, must be com­mu­ni­cat­ed to us as soon as pos­si­ble and in writ­ing. Should you need to can­cel, the fol­low­ing charges will be levied:

The above peri­ods refer to the date upon which we receive writ­ten noti­fi­ca­tion of your can­cel­la­tion.

Can­cel­la­tion fees are in many instances reclaimable (less the applic­a­ble excess) with the terms of your trav­el insur­ance pol­i­cy.

Can­cel­la­tion of indi­vid­ual trav­ellers with­in a group detailed on the Book­ing Con­fir­ma­tion will in addi­tion to can­cel­la­tion fees mean re-invoic­ing the remain­ing trav­ellers at prices cor­rect for the new par­ty size.

In the unlike­ly event that we have to can­cel your hol­i­day after a book­ing has been con­firmed by us, we will refund 100% of the price paid to us or offer you an alter­na­tive hol­i­day of the same val­ue (sub­ject to avail­abil­i­ty).

6. Insurance, Health and Visas

All clients of All Ways Spain must have per­son­al trav­el insur­ance that cov­ers trip can­cel­la­tion, acci­dent insur­ance, emer­gency expa­tri­a­tion and health and med­ical cov­er. We also rec­om­mend insur­ance for bag­gage and flight can­cel­la­tion. No lia­bil­i­ty will be accept­ed by us for any clients trav­el­ling with­out ade­quate trav­el insur­ance. A full pass­port is required to trav­el to Spain. Non EU/EEA res­i­dents should also check visa require­ments with their con­sulate.

7. Responsibility

We have tak­en all rea­son­able mea­sures to ensure that the holidays/activities offered by us and fea­tured on this web­site are prop­er­ly arranged and that the sup­pli­ers of any ser­vices includ­ed main­tain rea­son­able stan­dards. How­ev­er, we can­not be held respon­si­ble for events out­side our rea­son­able con­trol or if there has been no fault by us or by our employ­ees or sub-con­trac­tors. Nev­er­the­less, we will always endeav­our to imme­di­ate­ly rec­ti­fy any cause for dis­sat­is­fac­tion dur­ing your stay as soon as you noti­fy us (see para­graph 8. below).

We accept lia­bil­i­ty should you or any mem­ber of your par­ty suf­fer death, per­son­al injury, ill­ness, loss or dam­age as a result of any judi­cial­ly proven fail­ure to per­form, or improp­er per­for­mance of, any part of our con­tract with you by any of our employ­ees, agents, sup­pli­ers or sub-con­trac­tors (pro­vid­ing they were at the time car­ry­ing out work autho­rised by us) except in the fol­low­ing sit­u­a­tions. We will not be liable when fail­ure to per­form or improp­er per­for­mance was due to (i) the act(s) and/or omission(s) of the person(s) affect­ed or (ii) the act(s) and/or omission(s) of a third par­ty not con­nect­ed with the pro­vi­sion of your holiday/activity and which were unfore­see­able or unavoid­able or (iii) an event which either our­selves or the sup­pli­er of the service(s) in ques­tion could not have fore­seen or avoid­ed even with all due care.

We can­not be held respon­si­ble for the loss of enjoy­ment or addi­tion­al expens­es due to delays or changes in trav­el arrange­ments or oth­er ser­vices which are caused by cir­cum­stances amount­ing to force majeure such as war, riot, civ­il strife, ter­ror­ism, indus­tri­al dis­pute, nat­ur­al dis­as­ter, fire, flood or adverse weath­er con­di­tions.

Any infor­ma­tion or advice pro­vid­ed by us on such mat­ters as visas, cli­mate, cloth­ing, bag­gage, trans­porta­tion and the like is giv­en in good faith but with­out respon­si­bil­i­ty on our part.

8. Complaints

All Ways Spain endeav­ours to pro­vide holidays/activities of a high qual­i­ty and orig­i­nal con­tent. How­ev­er, if you feel the need to express your dis­sat­is­fac­tion on any mat­ter then please make your com­ments known to the All Ways Spain tour direc­tor, who will make every effort to achieve a sat­is­fac­to­ry solu­tion. Should this not be pos­si­ble it is impor­tant to con­tact us in writ­ing with­in twen­ty-eight (28) days of the end of the hol­i­day. Upon receipt of your e-mail or let­ter we will send you an acknowl­edge­ment, inves­ti­gate the points raised, and reply with­in four­teen (14) days or, if this is not pos­si­ble, send you an inter­im reply advis­ing you on our progress.

9. Arrivals and departures

We are not respon­si­ble for the trans­port which you use to get to the start or from the fin­ish­ing point of the itin­er­ary (oth­er than for any Air­port Trans­fer which we may pro­vide). We advise clients to ensure when book­ing flights to Spain and trans­port with­in the coun­try that their sched­uled arrival times allow for ample time to reach the stat­ed start of the holiday/activity list­ed in the Itin­er­ary which will be sent to you with your Book­ing Con­fir­ma­tion. Please ask us for advice and infor­ma­tion regard­ing your trav­el arrange­ments, as we are hap­py to help.

We can­not be respon­si­ble for any loss or expense which you may incur if you do not arrive at the appro­pri­ate start­ing point of the itin­er­ary and there­fore miss trans­fers or activ­i­ties includ­ed in the hol­i­day.

10. Website details

The details announced on our web­site are pub­lished in good faith, but it has to be kept in mind that cer­tain con­di­tions such as weath­er can some­times affect the facil­i­ties or activ­i­ties that we describe, lead­ing to changes in the Itin­er­ary. The infor­ma­tion on this web­site is sub­ject to change. Any sub­stan­tial changes to the itin­er­ary of your hol­i­day will be com­mu­ni­cat­ed before the con­tract with you is con­clud­ed.

11. Governing law and Jurisdiction

These Terms & Con­di­tions and all mat­ters aris­ing there­from are sub­ject to Span­ish Law and to the juris­dic­tion of the Span­ish courts.
