Terms & Conditions

Please read these booking Terms and Conditions carefully; they are the standard Terms & Conditions that apply to all business conducted with All Ways Spain (also hereafter referred to as “we”, “us” or “our”) and as such are an important part of your contract for your holiday. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these Terms and Conditions and agree to them.

1. Bookings

Once we have discussed with you and you have selected the arrangements you would like, please e‐mail to us all essential details thereof such as dates, the number and full names of people in your group/party, any special requirements and all relevant contact details. No payment will be processed until after we have confirmed availability of the services contemplated.

Provided the services you want are available, we will process payment of the correct deposit or full payment (as per paragraph 2. below) and send you by e‐mail a Booking Confirmation detailing your arrangements, names of persons booked, accommodation, and a copy of your full Itinerary. If we are unable to accept your booking for any reason we shall inform you of this by e‐mail and shall not process your payment.

A binding contract will come into force between us at the time we send out our Booking Confirmation, and until then we shall be under no liability to you whatsoever. Such contract shall be deemed to incorporate these Terms & Conditions.

The Booking Confirmation will be sent to the e‐mail address which you give us at the time of booking. You must ensure that this is a correct and valid e‐mail address. If you do not have an e‐mail address, please advise us of a suitable alternative form of contact which we can use instead.

If at any time there are changes in the details supplied to us by you it is your responsibility to inform us as soon as possible. In particular, it is essential that you advise of us of any alterations or substantial delays in your travel plans, as we shall bear no responsibility for any loss caused as a result of your failure to do so.

No person under the age of eighteen (18) will be permitted to book with us without the signed consent of a parent or legal guardian. We reserve the right to require of persons aged over seventy (70) a letter signed by their family doctor stating that they are capable of doing the trip and advising any medical conditions of which we should be aware.

Reservations made by agents and private groups are subject to these Terms & Conditions. If payment is made to an agent this is held on behalf of, and forms the basis of your contract with, All Ways Spain.

Please check your Booking Confirmation carefully upon receipt. Contact us immediately if any information is incorrect. It may not be possible to make changes later.

2. Payment

For bookings made more than six (6) weeks in advance of the commencement date of the holiday, services or arrangements we will request a Deposit of 25% of the total price to secure your booking, unless otherwise agreed between us. Until the time we receive the Deposit we will not make any reservations on your behalf and prices, availability and trip arrangements are not guaranteed.

The balance of the price of your holiday must be paid at least six (6) weeks before the holiday commencement date, unless otherwise agreed between us in writing. If the balance is not paid in time we reserve the right to cancel your holiday, services or arrangements, retain the Deposit, and apply the cancellation charges set out in paragraph 5. below.

If the commencement date of the holiday, services or arrangements is within six (6) weeks at the time of the booking then the total cost shall be payable in one instalment at the time of booking, except where otherwise agreed between us.

You may pay using either of the following payment methods:

By e‐mailing or telephoning us details of your credit or debit card (Visa and Mastercard only – please note we cannot accept other brands such as American Express); or

By bank/wire transfer in Euros to our Spanish bank account, for which you will need certain account details which will be sent to you by e-mail. PLEASE NOTE: all charges (sender and receiver) in relation any such bank transfer are for your sole charge, accordingly when issuing instructions to your bank please ensure that the fields “OUR” and “BEN” are both ticked.

The Booking Confirmation will include an acknowledgment of the payment made and will be sent upon completion of the transaction/our receipt of cleared funds. Please note that the cleared funds must represent the total sum payable to us for the holiday net of any bank charges which, as stated above, are your sole liability.

If we do not receive all payments in full and on time, we reserve the right to treat your booking as cancelled in which case cancellation charges will be payable (see paragraph 5 below).

3. Prices Include

All prices quoted are in Euros (€) and are per person, and include the items specified in our written correspondence. Where accommodation is included, unless otherwise stated, the accommodation price is based on two persons sharing a twin or double room.

Single Supplements: As our prices are based upon two people sharing a twin or double room, if you or anyone in your group requires a room for single occupation, please let us know. A supplement will be levied to cover the extra costs incurred, at the rates advised by us in correspondence with you.

We guarantee that the price of your arrangements will not be subject to any surcharges once a booking has been confirmed. We reserve the right to increase or decrease our prices at any time until the cost of your chosen holiday has been confirmed.

4. Prices do not include

Inclusions are a subject for individual agreement and may vary case by case, but in no circumstances are the following included in the arrangements we sell you:

  • Flights or other international travel to and from Spain
  • Travel insurance — this is your responsibility to obtain (please see paragraph 6. below)
  • Passport or visa fees (if any)
  • Any meals or drinks other than those specified in the Itinerary as included
  • All personal expenditures, including entrances, entertainment and transportation not included in the Itinerary, tips and gratuities
  • Any activities or excursions that are stated as in any way optional or additional and which we may offer, for which a separate price shall be payable

5. Amendments, cancellations and refunds

If you want to change anything to do with your booking after it has been made we will do our best to help. However, we may not always be able to meet your request and have no obligation to do so. If you decide to change your holiday in any way once it has commenced, we accept no liability for any loss, damage or additional expense that you may thereby incur and we cannot guarantee a refund of any costs already paid by you, such refunds being at our sole discretion and as may be reasonable in the circumstances. Without limitation to the remainder of these Terms & Conditions, we cannot refund any fees for activities or arrangements which form part of your Booking Confirmation if the notification of cancellation or amendment is given with less than 48 hours prior notice.

We will always endeavour to provide you with the arrangements as set out on the itinerary sent to you with your Booking Confirmation. However, it may be possible that some of the activities or accommodation may have to be changed by us for reasons beyond our control. We therefore reserve the right to substitute any activity, service or accommodation with another of equivalent or higher value. In the event that we can only locate substitute services or accommodations of a significantly lower level of quality, as determined by us in our reasonable discretion, we will refund you an amount equal to the difference in rates between the original and the replacement.

Any cancellation by you of a confirmed booking, for whatever reason, must be communicated to us as soon as possible and in writing. Should you need to cancel, the following charges will be levied:

Between 42 and 28 days
50% of total holiday cost
Between 28 and 14 days 75% of total holiday cost
Less than 14 days 100% of total holiday cost

The above periods refer to the date upon which we receive written notification of your cancellation.

Cancellation fees are in many instances reclaimable (less the applicable excess) with the terms of your travel insurance policy.

Cancellation of individual travellers within a group detailed on the Booking Confirmation will in addition to cancellation fees mean re-invoicing the remaining travellers at prices correct for the new party size.

In the unlikely event that we have to cancel your holiday after a booking has been confirmed by us, we will refund 100% of the price paid to us or offer you an alternative holiday of the same value (subject to availability).

6. Insurance, Health and Visas

All clients of All Ways Spain must have personal travel insurance that covers trip cancellation, accident insurance, emergency expatriation and health and medical cover. We also recommend insurance for baggage and flight cancellation. No liability will be accepted by us for any clients travelling without adequate travel insurance. A full passport is required to travel to Spain. Non EU/EEA residents should also check visa requirements with their consulate.

7. Responsibility

We have taken all reasonable measures to ensure that the holidays, services and arrangements offered by us are properly conducted and that the suppliers of any services included maintain reasonable standards. However, we cannot be held responsible for events outside our reasonable control or if there has been no fault by us or by our employees or sub-contractors. Nevertheless, we will always endeavour to immediately rectify any cause for dissatisfaction during your stay as soon as you notify us (see paragraph 8. below).

We accept liability should you or any member of your party suffer death, personal injury, illness, loss or damage as a result of any judicially proven failure to perform, or improper performance of, any part of our contract with you by any of our employees, agents, suppliers or sub-contractors (providing they were at the time carrying out work authorised by us) except in the following situations. We will not be liable when failure to perform or improper performance was due to (i) the act(s) and/or omission(s) of the person(s) affected or (ii) the act(s) and/or omission(s) of a third party not connected with the provision of your holiday, services or arrangements and which were unforeseeable or unavoidable or (iii) an event which either ourselves or the supplier of the service(s) in question could not have foreseen or avoided even with all due care.

We cannot be held responsible for the loss of enjoyment or additional expenses due to delays or changes in travel arrangements or other services which are caused by circumstances amounting to force majeure such as war, riot, civil strife, terrorism, industrial dispute, natural disaster, fire, flood or adverse weather conditions.

Any information or advice provided by us on such matters as visas, climate, clothing, baggage, transportation and the like is given in good faith but without responsibility on our part.

8. Complaints

All Ways Spain endeavours to provide holidays, services and arrangements of a high quality and original content. However, if you feel the need to express your dissatisfaction on any matter then please make your comments known to the All Ways Spain tour director, who will make every effort to achieve a satisfactory solution. Should this not be possible it is important to contact us in writing within twenty‐one (21) days of the end of the holiday. Upon receipt of your e‐mail or letter we will send you an acknowledgement, investigate the points raised, and reply within fourteen (14) days or, if this is not possible, send you an interim reply advising you on our progress.

9. Arrivals and departures

We are not responsible for the transport which you use to get to the start or from the finishing point of the itinerary (other than for any Airport Transfer which we may provide). We advise clients to ensure when booking flights to Spain and transport within the country that their scheduled arrival times allow for ample time to reach the stated start of the holiday, services or arrangements listed in the Itinerary which will be sent to you with your Booking Confirmation. Please ask us for advice and information regarding your travel arrangements, as we are happy to help.

We cannot be held responsible for any loss or expense which you may incur if you do not arrive at the appropriate starting point of the itinerary and therefore miss transfers or activities included in the holiday.

10. Website details

The details announced on our website are published in good faith, but it has to be kept in mind that certain conditions such as weather can sometimes affect the facilities or activities that we describe, leading to changes in the Itinerary. The information on this website is subject to change. Any substantial changes to the itinerary of your holiday will be communicated before the contract with you is concluded.

11. Governing law and Jurisdiction

These Terms & Conditions and all matters arising therefrom are subject to Spanish Law and to the jurisdiction of the Spanish courts.
